An Assured Shorthold Tenancy Agreement (AST Agreement) is a legally binding residential tenancy agreement between the Landlord and the Tenant which governs the terms and conditions under which the tenancy is to operate. AST’s are regulated by the Housing Act 1988 as amended by the Housing Act 1996 and are only permitted in cases where the rental is under £100,000 per year and the initial fixed term is less than three years. An AST is particularly advantageous to a Landlord as it gives the Landlord a guaranteed right to repossess the property at the end of the fixed term. It is, however, important to note the requirements of the Housing Act in respect of AST’s and whether or not an AST Agreement is permitted over a specific property. For example, it is a requirement for AST’s that the Tenant is an individual (i.e, not a company), that the property is separate accommodation and that the property be maintained as the Tenant’s principal home. Furthermore, the Tenant is required to pay rent, which cannot be unreasonably low, nor can it exceed the annual threshold of £100,000. There are other exclusions, such as holiday lettings, tenancies granted by a resident Landlord (a Landlord who lives in the same property as the Tenant), tenancies let with property which has more than 2 acres of agricultural land and tenancies entered into before 15 January 1989.
