The Section 8 Notice is a legal document used by Landlords to gain possession of their property in terms of the provisions of the Housing Act 1996.
The Section 8 Notice should only be used in circumstances where one of the grounds listed in Schedule 2 of the Housing Act 1988 is present. Furthermore, the Section 8 Notice may only be used in cases where the properties are subject to the following tenancies:
1. Assured tenancy;
2. Assured Agricultural Occupancy; and
3. Assured Shorthold tenancy (AST).
The Section 8 Notice may not be used in respect of AST’s in the following instances:
1. Where the fixed term has come to an end; or
2. Where there is no fixed term and a period of 6 months has elapsed (provided the AST commenced on or after 28 February 1996).
