The Section 21(1)(b) Notice Requiring Possession is a legal document used by Landlords to gain possession of their property at the end of the tenancy in terms of the provisions of the Housing Act 1988.
The Section 21(1)(b) Notice should only be used in circumstances where the properties are subject to an assured shorthold fixed tenancy. The Section 21(4)(a) Notice may not be used in respect of any other tenancies, including where the AST is a periodic tenancy.
The Section 21(1)(b) Notice requires the Landlord to provide the Tenant with a minimum of 2 months’ notice and such notice may not be given before commencement of the fixed term.
