The Section 25 Notice (not opposing) is a legal document used by Landlords of business premises to terminate the existing tenancy (at the end of the tenancy) and propose a new tenancy in terms of the provisions of the Landlord and Tenant Act 1954.
The Section 25 Notice (not opposing) should only be used in circumstances where the properties are let as business tenancies.
The Section 25 Notice (not opposing) may not be used in cases where the Landlord and the Tenant have specifically excluded the Tenant’s right to security of tenure in terms of the Landlord and Tenant Act 1954, or where the Tenant has already served a Section 26 Notice on the Landlord.
The Section 25 Notice (not opposing) requires the Landlord to provide the Tenant with between 6 to 12 months’ notice. Furthermore, the Section 25 Notice (not opposing) must include a Schedule detailing the proposed terms of the new tenancy (including procedures to be followed on agreement or where there is no agreement) in order for it to be valid.
