A Tenancy at Will is a legally binding agreement made between the Landlord and the Tenant which governs the terms and conditions under which the lease is to operate. In terms of this agreement, the Landlord grants the Tenant a right of lease to the property with the mutual agreement that the tenancy is terminable at any time by either of the parties.
This agreement is particularly suited to cases where the lease is for a short period of time and/or the parties have not had time to finalise a formal tenancy agreement but wish to have some form of written agreement in place until the formal tenancy agreement is concluded. It is an informal agreement containing the essential clauses necessary to ensure that both parties’ interests are protected.
A Tenancy at Will is advantageous in that the parties need only provide reasonable notice in order to terminate the tenancy.
