The Section 25 Notice (opposing) is a legal document used by Landlords of business premises to terminate the existing tenancy (at the end of the tenancy) and confirm opposition to any proposed new tenancy in terms of the provisions of the Landlord and Tenant Act 1954.
The Section 25 Notice (opposing) should only be used in circumstances where the properties are let as business tenancies.
The Section 25 Notice (opposing) may not be used in cases where the Landlord and the Tenant have specifically excluded the Tenant’s right to security of tenure in terms of the Landlord and Tenant Act 1954, or where the Tenant has already served a Section 26 Notice on the Landlord.
The Section 25 Notice (opposing) requires the Landlord to provide the Tenant with between 6 to 12 months’ notice. Furthermore, the Section 25 Notice (opposing) must include a list of the reasons for disallowing the Tenant from renewing the tenancy. These reasons may be challenged by the Tenant.
