An Ordinary Power of Attorney is a legal document between the Donor and the Attorney(s) authorising the Attorney(s) to perform functions and/or make decisions on behalf of the Donor, usually relating to the Donor’s financial affairs and/or personal welfare. An Ordinary Power of Attorney can be used in cases where the Donor is unable to act, however it cannot be used where the Donor lacks mental capacity and a Lasting Power of Attorney should be used in these circumstances (provided of course that it is created before the incapacity arises). The Ordinary Power of Attorney may be terminated either on a specific date and/or in terms of a Deed of Revocation executed by the Donor.
This agreement has been drafted specifically for cases where the authority granted to the Attorney(s) is limited to specific affairs, examples of which include the following:
- The management of a bank account for a sick or disabled family member;
- The purchase or sale of a property whilst the owner or the buyer is abroad;
- The management of share portfolio’s and/or other investment portfolios.
